Primary responsibilities in the area of bankruptcy related litigation, including representation of debtors, creditors, and defendants in large fraudulent transfer actions. Provide advice regarding bankruptcy implications of various corporate transactions.

Associate, Business Finance & Restructuring Department
Representation of debtors, secured and unsecured creditors, creditors' committees and equity security holders in commercial transactions, bankruptcy proceedings and workouts. Responsibilities include drafting bankruptcy petitions, and initial "first day" documents, stipulations, motions, pleadings, memoranda of law, plans of reorganization and disclosure statements. Extensive litigation experience including handling large scale document discovery, responding to interrogatories, preparation of witnesses for deposition and trial, taking and defending depositions, including the deposition of expert witnesses, arguing motions, attending and preparing for trial and other hearings, counseling clients in litigation and negotiating settlements of various types of litigation.
Research numerous legal issues relating to bankruptcy including fraudulent transfer, valuation, and executory contract issues; advise corporate and real estate departments on bankruptcy matters including issues relating to swap agreements and ground leases; draft motions and memoranda of law for internal analysis and litigations, including appellate briefs to the Second and Third Circuit; assist in negotiating settlements of adversary proceedings.
Represent secured creditors, trustees, creditors' committees and debtors in Chapter 11 cases; prepare and argue contested motions pertaining to plan confirmation, cash collateral use and other complex bankruptcy issues; prosecute and defend adversary proceedings and state court litigations including pre-trial motion practice; conduct depositions and discovery; assist in research and drafting of appellate briefs; substantial court appearances and extensive client contact.
Representation of debtors in complex bankruptcy/reorganization cases; draft plans of reorganization, disclosure statements, motions to approve financing, sales transactions, lease assumption and rejection and numerous other matters; negotiate and document plans and agreements; argue motions in bankruptcy court; prepare motions and discovery materials in civil litigation matters; present motions and arguments in state court; pro bono representation of low income housing lender in multiple dwelling mortgage loans and tenants' coalition in rent strike, including litigation in housing court.
Representation of private and publicly held businesses in all aspects of complex bankruptcy proceedings. Draft motions, pleadings and briefs. Argue before the bankruptcy courts for the Southern and Eastern District of New York. Directly advise clients on various aspects of bankruptcy law. Render bankruptcy advice in connection with corporate transactions.
Represent various secured and unsecured creditors. Worked on reorganization of major chapter 11 debtor. Review commercial leases and other financial documents. Draft memoranda of law, appellate briefs, motions, affidavits, declaration and proofs of claim; review and draft portions of chapter 11 plans and represent plaintiffs and defendants in preference actions. Work closely with clients and appear frequently in bankruptcy court.
